Exceptions to the work test

If your ability to work has been affected, you may be able to get an exception to meet the work test for Parental Leave Pay in certain circumstances.

Your work test period is the 13 months before the birth or adoption of your child. You need to have worked at least 10 consecutive months within the 13 month work test period.

To meet the work test, you need to have worked at least 330 hours in the 10 month period with no more than a 12 week gap between work days.

If certain circumstances affected your ability to work during the 13 month work test period, you may be eligible for an exception to the work test. You’ll need to provide documents to prove your situation.

You’ll need to provide your documents to us when you submit your claim online.

Exceptions to the work test include:

  • pregnancy related illnesses and complications
  • premature birth
  • severe medical conditions for you or someone you care for
  • family and domestic violence
  • dangerous jobs or workplace hazards
  • natural disasters.
