A Notice of past benefits is valid for 6 months. If judgment or settlement happens while it’s valid, your final Notice of past benefits becomes your Notice of charge.
Your Notice of charge states the total amount that you need to repay.
If you don’t have a valid Notice of past benefits on judgment or settlement date, you’ll need a new one.
We’ll send you a new Medicare history and care services statement and Declaration. You need to complete this and send it back to us.
If the Notice of past benefits is not valid, the compensation payer may choose to make an advance payment on your behalf. This advance payment amount must be equivalent to 10% of the total judgment or settlement sum. If the Notice of charge amount works out to be less than the advance payment we have received, we’ll refund the difference. If the Notice of charge amount is more, you’ll need to pay us the difference.
The compensation payer must pay us the Notice of past benefits, Notice of charge, or an advance payment before paying you the remainder of the judgment or settlement sum.
