You can get Dad and Partner Pay for up to 2 weeks. During this time, you must not do either of the following:
- work in the same period
- take paid leave in the same period.
Your payment will normally stop if you return to work before the end of your 2 week period.
We don’t consider workers compensation or a top up payment from your employer as paid leave.
If you’re self-employed, you can do occasional tasks to check on your business. We won’t consider you as having returned to work. We also don’t consider you working if you do voluntary work.
You can change your start date to a period when you won’t be working or taking paid leave.
What it means if you got the COVID-19 Disaster Payment
You can’t get COVID-19 Disaster Payment at the same time as Dad and Partner Pay. You can only get Dad and Partner Pay after your COVID-19 Disaster Payment has ended.
You may still get Dad and Partner Pay if you work for allowable reasons. These include if you:
- need to work to comply with a court ordered summons
- are a defence force or law enforcement officer working due to a compulsory recall to duty
- are a health professional, emergency services worker or other essential worker, responding to a state, territory or national emergency.
You’re an essential worker if you either:
- have specific skills essential in responding to an emergency
- are involved in the production of goods or the delivery of services essential in responding to an emergency.

In cases of a stillbirth or infant death, you can still get Dad and Partner Pay even if you’re either:
- on paid leave.
