Complete a Section 23A statement

Complete a Section 23A statement after judgment or settlement if no notice of past benefits has been issued in the last 6 months, or if a previous notice has expired.

The Section 23A statement can be completed and given to us by the injured person, claimant or their authorised third party if a valid Medicare Compensation Recovery Third party authority form (MO021) is supplied.

By completing the Medicare Compensation Recovery Section 23A statement you’re declaring that, on the date the amount of compensation was fixed, you’ve either not received:

  • eligible benefits in relation to your injury or illness
  • further eligible benefits in relation to your injury or illness since the expired notice of past benefits.

Send the completed statement and declaration to us by email or post using the details on the form.

When we get the statement and settlement documents from the compensation payer, we’ll send a notice of charge to the relevant party. This tells them how much must be repaid to us.

If we send a notice of charge to the compensation payer, we’ll also send you a copy for your records.

The compensation payer uses the notice of charge to pay us first. Then they pay the rest of the compensation amount to you. This usually takes up to 3 months.

If the compensation payer made a valid advance payment to the agency, we’ll send you the final notice.

We’ll refund you if you didn’t receive any eligible benefits, or the eligible benefits were less than the advance payment amount.

If the eligible benefits were more than the advance payment amount, you’ll need to repay the difference.
